Traffic Stop for failing to use Turn Signal nets Meth Arrest

Last night at approximately 7:20, Trooper Widner was patrolling in the area of US 41 and Yokel Road when he stopped the driver of a 2006 Ford Mustang for failing to signal when required.

The driver was identified as Brandy Newcom, 39, of Morganfield, KY. Suspicious activity was detected and a search of the vehicle was conducted.

She was arrested and charged with:

  1. Possession of Methamphetamine, Level 6 Felony
  2. Possession of a Controlled Substance, Class A Misdemeanor
  3. Possession of Paraphernalia, Class C Misdemeanor

Troopers located approximately 2.3 grams of methamphetamine, a controlled substance and drug paraphernalia.

Newcom also had an active warrant out of Vanderburgh County for theft. Newcom was arrested and taken to the Vanderburgh County Jail where she is currently being held without bond.

23-Year-Old Evansville Woman Arrested for Dealing Meth

Last night at approximately 9:50, Trooper Widner was patrolling in the area of US 41near Lynch Road when he stopped the driver of a 2002 Lexus for making an unsafe lane change.

The driver was identified as Destennie Holtzclaw, 23, of Evansville.

She was arrested and charged with:

  1. Dealing Methamphetamine, Level 2 Felony
  2. Possession of Methamphetamine, Level 3 Felony
  3. Possession of a Look-a-Like Substance, Class A Misdemeanor
  4. Possession of Paraphernalia, Class C Misdemeanor

While talking to the driver an odor of marijuana was detected from inside the vehicle.

A search of the vehicle was conducted and troopers found approximately 23 grams of methamphetamine, two THC gummies, and drug paraphernalia.

Further investigation revealed Holtzclaw was dealing with the suspected methamphetamine.

Holtzclaw was arrested and taken to the Vanderburgh County Jail where she is currently being held without bond.

 

DRUG ARREST IN CAMPBELLSBURG

Tuesday officers with the Washington County Drug Team, Washington County Sheriff’s Department and the Indiana State Police executed a controlled buy-bust at 425 S. Sycamore Street in Campbellsburg, Indiana.

Deborah Matlock, age 63 of Campbellsburg was arrested on dealing Methamphetamine and possession of Methamphetamine related charges.

The arrest lead officers to apply for a search warrant for an apartment at the complex.

After receiving and executing a search warrant, at the complex, officers located and seized more Methamphetamine and other drug-related items.

All suspects are considered innocent until proven guilty in a court of law.

Police Looking For Suspects Who Fired Shots Outside of Paoli Walmart

The Paoli Police Department is looking for two people who are believed to have fired gunshots outside of Walmart in Paoli on Tuesday. 

On December 17 on or about 7:13 pm the Paoli Police Department was notified of what was believed to be multiple shots fired in the parking lot of Walmart at 735 N Gospel St. Paoli, Indiana.

There were no injuries. 

Initial investigation determined there were in fact several shots fired by two individuals.

This incident is believed to be isolated and no longer active.

It is believed there is no continuing danger for Paoli residents.

Prosecutor Says Police “Did Nothing Wrong” In Risinger Interrogation

The Indiana Court of Appeals has overturned the murder conviction of Joshua Risinger, who was arrested and tried for setting a 2017 fire at his trailer that killed a homeless man, saying police “failed to scrupulously honor″ his right to remain silent.

Risinger appealed with several arguments, including that the trial court wrongly allowed statements he made to police where he said, “I’m done talking.″

In an opinion issued this month, the appeals court agreed. The three-judge panel said while Risinger could’ve been clearer in invoking his Miranda rights, the law doesn’t require such a formal declaration.

His statement was “an unequivocal invocation of his right to remain silent pursuant to Miranda, and the detective’s continuation of questioning thereafter was a failure to scrupulously honor that right,” according to the decision.

The decision was handed down on December 9 and Washington County Prosecuting Attorney Dustin Houchin says he is working to file an objection with the Supreme Court to overturn the appeal.

“The Court of appeals overturned the murder conviction,” said Houchin. “They found that the defendant’s right to remain silent was violated because police questioning continued after he said he was “done talking.” 

Risinger pled not-guilty in March 2017 in Washington County Circuit Court to a murder charge he was facing after he told police he set fire to his trailer at Southway Villa Mobile Home Park earlier that week. 

He was found guilty having been found guilty by Jury Trial on November 30‘“, 2019 of COUNT 1, Guilty but Mentally ill at the time of the offense of Murder, Felony; COUNT 2, Guilty but Mentally ill at the time of the offense of Felony Murder and COUNT 3, Guilty of Arson.

“I want to be clear that the Indiana State Police did nothing wrong in this case,” said Houchin. “The way the officers questioned the defendant was within the law.”

Risinger allegedly told police he killed a man named “Gilbert” by starting a fire in the home. The body was later identified as 62-year-old Jeffery Givan.

“This Court of Appeals opinion is, in my view, an expansion of existing law, and not consistent with prior opinions of the Indiana higher courts,” Houchin said. “Such a ruling could not have been anticipated by the police at the time.  I am currently working with the Indiana Attorney General’s Office to request [a] review of this opinion by the Indiana Supreme Court.  I believe we have a good chance of the Supreme Court reviewing it because it is out of line with prior cases.”

Houchin said Risinger will remain incarcerated. 

“This ruling does not set him free.  We have 45 days to request a transfer, and the defense will have 20 days after that to respond. In all, we are looking at several months before we know. If we are not successful with the Supreme Court review, the case will return to the Washington Circuit Court.  At that time, I will retry the case.”

The office of Indiana Attorney General Curtis Hill’s office said: “We are evaluating the matter and will vigorously defend the State’s interests.”

Risinger remains in custody at Miami Correctional Facility in Bunker Hill.

Traffic Stop Leads to Discovery of Altered Handgun

Friday at approximately 10:40 p.m., Trooper Ian Portteus observed a black passenger vehicle with expired plates at Wabash Avenue and 22nd Street. 

Trooper Portteus activated his emergency lights and initiated a traffic stop at this location. 

Arrested and Charges were:  

Neil A. Kraemer, 38, Shelbyville, IN 

  • Altered Handgun, Class 5 Felony
  • Possession of Handgun Without Permit, Class A Misdemeanor
  • Possession of a Schedule V Controlled Substance, Class A Misdemeanor  

Travis J. Fagg, 34, West Terre Haute, IN

  • Operating a Vehicle While Intoxicated, Class A Misdemeanor
  • Operating a Vehicle While Intoxicated Endangering a Person, Class C Misdemeanor 

Trooper Portteus proceeded to speak to the driver and the passengers in the vehicle.   During his conversation with the occupants, Trooper Portteus immediately detected criminal indicators.  

The driver was identified as Travis J. Fagg, age 34, of West Terre Haute, Indiana. 

A passenger in the vehicle was identified as Neil A. Kraemer, age 38, of Shelbyville, Indiana.   A free air sniff was performed on Fagg’s vehicle by Indiana State Police K-9, Czar, who gave a positive indication for illegal contraband. 

A search was then performed on Fagg’s vehicle, where a loaded handgun with the serial number filed off was found. 

During the course of the investigation, the handgun was found to belong to Kraemer, who did not have a valid gun permit.  He also attempted to destroy contraband located in his underwear by urinating in his pants. 

Kraemer was taken into custody and was transported to the Vigo County Jail where he is currently being detained.  

The investigation also revealed that Fagg was driving under the influence.  Fagg refused to submit to a certified chemical test and was also taken into custody and transported to the Vigo County Jail.

Traffic Stop Leads to Discovery of Stolen Handgun

Thursday, December 12, 2019, at approximately 11:30 p.m., Trooper Brad Fyfe observed a gold Buick passenger vehicle, traveling above the posted speed limit on US 41 south of Poplar Street. 

Arrested and Charges:  Kenneth J. King, 21, Fort Wayne, IN

  • Theft of Fire Arm, Level 6, Felony
  • Possession of Marijuana,  Class A Misdemeanor

The vehicle was traveling 50 mph in a 30 mph zone. Trooper Fyfe activated his emergency lights to initiate a traffic stop.  The Buick immediately pulled over and came to a stop.  

Trooper Fyfe proceeded to speak to the driver of the vehicle, who was identified as King.

During his conversation, Trooper Fyfe immediately detected suspicious activity and criminal indicators. 

A search was then performed on King’s vehicle, discovering that King was in possession of a stolen handgun and marijuana.  During the course of the investigation, it was also discovered that King was wanted out of Clark County for possession of marijuana. 

King was taken into custody and was transported to the Vigo County Jail where he is currently being detained.  

Louisville Man Arrested Following Twenty Mile Pursuit

Friday at approximately 1:30 pm, a Louisville, Kentucky man was arrested on numerous charges after leading police on a twenty-mile pursuit through two counties.

The Indiana State Police initially received a report of a 2002 Toyota Tacoma traveling erratically on I-65 northbound in Jackson County, Indiana. 

Trooper Andrew Garrett located the vehicle and observed erratic driving behavior.  The vehicle was also traveling well above the posted speed limit. 

Trp. Garrett attempted to stop the vehicle on I-65 Northbound near the 51-mile marker, just north of Seymour.  The driver, Russell J. Bradley, age 42, Louisville, KY accelerated and fled northbound on I-65 from Trp. Garrett. 

Numerous troopers from the Indiana State Police-Versailles Post and deputies from the Bartholomew County Sheriff’s Office assisted in pursuing the vehicle. 

Troopers deployed a tire deflation device near the 67-mile marker near Columbus, Indiana in Bartholomew County.  The vehicle slowed and eventually came to a stop on I-65 Northbound near the 72-mile marker.

Bradley resisted officers at the scene before eventually being taken into custody.  Bradley was transported to Columbus Regional Hospital where he was evaluated for injuries. 

He was soon discharged from the hospital and transported to the Jackson County Jail where he was incarcerated on numerous charges pending an initial appearance in the Jackson County Circuit Court.

A trooper sustained a minor injury to his hand while taking Bradley into custody.  The trooper was evaluated at Columbus Regional Hospital.

Northbound lanes of I-65 were closed briefly during the arrest.

Wrong Way Driver arrested for Driving While Impaired

Early this morning at approximately 2:50, Knox County Dispatch received a 911 call regarding a vehicle traveling westbound in the eastbound lane on US 50 near Anson Road. 

Knox County Sheriff’s Deputy Roberts spotted the vehicle still traveling westbound in the eastbound lane near Mt. Zion Road and was able to stop the vehicle.

The driver was identified as Joshua Conley, 41, of Olney, IL. Further investigation conducted by Trooper Nick Hatfield revealed Conley was impaired.

Conley refused to submit to a chemical test. He was arrested and taken to the Knox County Jail where he is currently being held on bond.
