The Washington County Commissioners could be in jeopardy of losing a $1.8 million Community Crossing Grant — and possibly be banned from participating in the future — due to awarding the job to a local company that would do the work for a higher price over another company who had a lower bid.
The Indiana Department of Transportation was alerted that at the Commissioner’s May 6 meeting, the board voted 2-1 to award a $1.8 million paving contract to Temple & Temple, despite Harrison County-based company C&R Construction submitting a bid for $1,899,757 – that was $78,096 lower.
The board received a letter on May 27 from INDOT and was asked to respond within 7 days. It is not known whether a response was provided by their deadline. A special meeting is planned for Tuesday, June 10 at 9a to discuss the Community Crossings Paving Bid selection.
The INDOT letter notes that the Board of Commissioners is in “Material Breach” of the contract with INDOT regarding the bidding process for a Community Crossing Grant for an upcoming road project.
In the letter, INDOT states that Indiana Code 36-1-12-4 “the board shall (emphasis added): A) award the contract for public work or improvements to the lowest responsible and responsive bidder; or (B) reject all bids submitted.”
The letter, from Kathy Eaton-McKalip, INDOT Director of Local Programs, states that “to ignore the statutory requirements renders the entire process suspect.”
“Indiana law provides that the purpose behind the competitive bid statutes is to safeguard the public against fraud, favoritism, graft, extravagance, improvidence and corruption, and to ensure honest competition for best work at lowest reasonable cost,” the letter states.
Eaton-McKalip also notes that a provision in the contract between INDOT and the county states that “the Grantee shall comply with all applicable federal, state and local laws, rules, regulations and ordinances….”
She also notes that failure to comply with those laws and rules would cause the state to suspend the grant payments and possibly suspend the county from receiving future grants until “all material breaches are cured to the State’s satisfaction.”
The state is asking the board to award the bid to the lowest bidder to avoid the risk of suspension of the grant payments.
Commissioners Todd Ewen and Phillip Marshall voted to go with Temple’s bid, while Commissioner Tony Cardwell voted against the action.
Shirley Yvonne Maack, 84, of Salem, Indiana, passed away on June 4, 2025 at Ascension St. Vincent Salem Hospital. Born on March 19, 1941 in Salem, she was the daughter of the late Arley Brewer and Dorothy Brewer.
Shirley was a retired Insurance Agent for Farmers Insurance in Petaluma, California. She was a member of Enon Baptist Church.
She is survived by 3 children, Lori Silvers (Jim), Mark Hall, and Lisa Trammell (Frank); brother, Larry Brewer; 9 grand children, Michele Conner, Vanessa Bengtsson, Shannon Conner, Christopher Conner, Justin Chavez, Christina Einers-Cameron, Rachel Rodrigues, Robert Keading, and Austin Maack; 10 great grand children.
Preceded in death by her parents; daughter, Cheryl Chavez; brother, Arley Brewer Jr.; sister, Wanda Alred.
Cremation was chosen.

Michael “Duff” Scott Fultz, age 59 of Salem passed away May 23,2025 at Baptist Health Floyd.
Mr. Fultz was born September 10, 1965, in Salem, the son of Randall Fultz and Barbara Hasty Gilstrap. He was a member of VFW #6636 and American Legion Post #41. Micheal was a former forklift driver for KYB in Franklin, Indiana.
Mr. Fultz is survived by two daughters, Alley Kate Gibson of Pekin and Lilly Lee Applegate (Andrew) of Lexington, Indiana. Four grandchildren, Rayleigh, Phoenix, Raymond, and Clayton. Three brothers, Randall Darrell Fultz Jr. (Shelia) of Salem, Richard Wayne Fultz (Heather) of Salem, and Jonathon Spencer Gilstrap (Ashley) of Salem. A sister, Tanja Sue Ramsby (Corey) of O’Fallon, Illinois. He is also survived by his stepmother, Carolyn Fultz of Salem and his beloved dog, Lobo.
Mr. Fultz is preceded in death by his parents, two grandchildren, Ayden and Wrenleigh, and a sister, Newlona Myle Carter.
Cremation was chosen. Per Mike’s request there will be no funeral service. A private celebration of life was held on June 1, for immediate family and friends.
A private graveside service will be held at a later date, as well as a community celebration of life.

Julene M. (Green) Robinson of Marengo, Indiana.
Julene was born in Corydon, Indiana in the late Athloan C. “Deacon” and Lorain V. (Haselman) Green.
She married Gary Robinson on February 26, 1999.
She was a commercial driver delivering motorhomes across the country. She attended the former Marengo Wesleyan Church. She loved her cats and dogs, raising flowers and gardening, and loved spending time with her family and her grandchildren.
Julene was preceded in death by her parents and sisters, Virginia Green and Irene Williams.
She is survived by her husband, Gary Robinson; daughter, Cheryl Stacey (Donnie) of Milltown, Indiana; grandchildren, Chantel Small (Brandon “Bub”) and Desirea Sparks (Tim); and her pride and joy, great-granddaughter, Avery Marie Goldman.
Funeral services will be on Friday, June 6, 2025 at 1:00 p.m. at the Brown Funeral Home in Milltown, Indiana. Interment will follow in the Marengo Cemetery.
Visitation will be on Thursday, June 5, 2025 from 4:00 to 8:00 p.m. and after 9:00 a.m. until time of the service at 1:00 p.m. on Friday, all at the funeral home.
Rev. Philo Jones will officiate the funeral service.

Lorna Strojny, age 72, of Borden passed away peacefully Friday, May 30, 2025. Born March 19, 1953 in New Albany, she was the daughter of the late Joy Wheeler and Dorothy (Hammonds) Wheeler.
Lorna went to cosmetology school and never stopped doing hair even after she became an Academic Advisor at Ivy Tech (retired.) At heart, she was a Caregiver. She was a member of the First Christian Church of Borden, the Borden Braves Foundation, and the NRA.
She is survived by her daughters, Erika Myers (Stuart); Ashley Spice (Graham); brother, Jerry Bidwell; 3 sisters: Joy Carolyn Sumner (Sam), Diana Hall (James,) and Teresa Rutherford; and five (5) grandchildren: Isaac Myers, Nathaniel Myers, Gabriel Myers, Henry Spice, and Lila Spice.
She was preceded in death by her parents, Joy and Dorothy Wheeler; and brother, Danny Bidwell.
Funeral services will be held Saturday, June 7, 2025 at 11:00 a.m. at the First Christian Church of Borden with Bro. Brian Combs officiating. Visitation will be held Friday, June 6, from 1:00 p.m. to 7:00 p.m. at the church and Saturday from 9:00 a.m. until time of service.

James Hobart White, age 81, of Salem, Indiana, passed away peacefully at his home on Wednesday, June 4, 2025.
He was born on April 6, 1944, in Mitchell, Indiana, to James S. and Agnes I. (Porter) White. James was a 1962 graduate of Mitchell High School.
He went to work after high school and spent 34 years as an employee and supervisor at Cummins Engine Company. He also drove riders from the area to and from Cummins for about half that time, racking up almost a million miles.
He married Lena Ann Rexroat on October 5, 1973.
After retirement, they moved to Baldwin, Michigan where he could fish for salmon and hunt mushrooms. He also worked as a greenskeeper at a golf course there.
After moving back to Salem in the late 90s, he worked as the manager of Western Hills Golf Country Club in Salem. He was also employed at Temple and Temple Excavating and Paving.
It was also during the late 90s that he rededicated his life to the Lord and was baptized at Mill Creek Baptist Church, where he is a member.
Jim had a deep love for the outdoors and spent nearly all his life outdoors hiking, fishing, golfing, hunting for deer, squirrel, rabbits, turkey, mushrooms and ginseng. He also loved sports and was an avid golfer and softball player and bowled on several leagues at the Salem Lanes bowling alley. He loved watching NASCAR, was a fan of IU basketball and the Cincinnati Reds. He especially loved working with flowers and his garden; especially his Knockout Roses..
He is survived by his loving wife, Lena Ann (Rexroat) White; two brothers, Robert (Barbara) White and Harold (Sheila) White, both of Mitchell; and a sister, Barbara (Gary) Blevins, of Mitchell; one son, Greg White (Becky) of Salem, Indiana; one daughter, Melissa (Clyde) Shilling of Florida.
He is also survived by seven granddaughters: Abree (Eric) McAninch of Bedford, Indiana; Abigail (Adam) Clem of Salem, Indiana; Angel (Brett) Purlee of Salem, Indiana; Alexandria (Jared) McNeely of Salem, Indiana; and Addison White and Aspen White, both of Salem and Autumn (Nicholas) Palmer of Florida, Trey Shilling and 16 great-grandchildren.
He was preceded in death by his parents, two sisters, Delores Lloyd and Patty Clipp, both of Orleans, and one son, Mark David White, St. Petersburg, Florida.
Visitation will be held at Hughes-Taylor Funeral Home in Salem on Saturday, June 7th, from 10:00 am until 2:00 pm.
Funeral services will follow at 2:00 pm at the funeral home, with Brother Jared Hardin officiating.
Burial will follow at Crown Hill Cemetery in Salem.
Teresa Rutherford, age 74, of Borden passed away Tuesday, June 3, 2025 at her residence.
Born September 2, 1950 in New Albany, she was the daughter of the late Joy Wheeler and Dorothy (Hammonds) Wheeler. On October 14, 1991, she married Paul “Bob” Rutherford who preceded her in death on January 19, 2024.
Teresa was an accountant, devoting much of her time to non-profit organizations; she was a member of the First Christian Church of Borden, the Borden Braves Foundation, and the NRA.
She is survived by her daughter, Holly Thompson (Chris); son, Bob Rutherford (Amy); brother, Jerry Bidwell; 2 sisters: Joy Carolyn Sumner (Sam) and Diana Hall (James);and six (6) grandchildren: Gracie Mauck, Emma Mauck, Chloe Rutherford, Rachael Rutherford, Hunter Rutherford, and Layla Rutherford.
She was preceded in death by her parents, Joy and Dorothy Wheeler; husband, Paul “Bob” Rutherford; brother, Danny Bidwell; and sister, Lorna Strojny.
Funeral services will be held Saturday, June 7, 2025 at 11:00 a.m. at the First Christian Church of Borden with Bro. Brian Combs officiating.
