A Henryville, Indiana mother plead guilty earlier today in connection to a crash with a train that killed her two children last year.
Ericka Fouch plead guilty to two counts of causing death while operating a motor vehicle while driving under influence of a controlled substance and one count of driving without a license during a hearing in Clark Circuit Court in Jeffersonville Monday.
Prosecutors accepted her plea deal and dropped the charge of neglect of a dependent resulting in death.
According to police, Fouch had been under house arrest after posting a $10,000 cash bond.
She will remain on home incarceration until she has been formally sentenced on March 8.
Police arrested Fouch in September, three months after her two children were killed in the crash with a CSX train in Henryville.
The crash took place on June 28 at a railroad crossing on State Road 160 near Pennsylvania Street killing Adalynn Fouch, 5, and Wyatt Fouch, 4, who were in the back seat.
The children were both in the car and emergency personnel found that both had weak pulses and were partially trapped inside the car Fouch was driving, a 2005 Mitsubishi SUV. The children were later pronounced dead before they were able to be removed from the car.
Autopsies of the children listed the causes of death as multiple blunt force trauma injuries. Adalynn also sustained a skull fracture and Wyatt a broken neck.
Ericka Fouch was taken to University Hospital and underwent surgery.
Fouch was arrested in September after toxicology results indicated she was under the influence of drugs. Police said her driver’s license was suspended at the time.
Clark County Prosecutor Jeremy Mull said “A BLOOD SAMPLE DRAWN AT THE SCENE SHOWS ERICKA FOUCH HAD NORDIAZEPAM, AMPHETAMINE, METH-AMPHETAMINE AND THC OR MARIJUANA IN HER SYSTEM.”
“The investigation has been ongoing since the collision occurred,” said Mull. “We had been awaiting the results of the toxicology. Upon receiving those I did file these charges because of the results they contained.”
Mull said the investigation revealed that approximately one hour before the accident Fouch admitted to usingdrugs.
“I know that she had meth and THC which is a result of using marijuana in her system and that as a result of that she has violated these Indiana statutes. These penalties carry a potential 42 years of incarceration. I will say that it is very unfortunate to have to file these charges under these circumstances,” Mull said.
Investigators examined video from the CSX train that showed the SUV driven by Ericka Fouch did not stop before it hit the train. Video and audio showed the train was blowing its horn, as it approached the flashing railroad intersection, court records said.

Born April 11, 1970 in Salem, Indiana, she was the daughter of Danny and Carolyn (Pendygraft) Davidson.
She was a homemaker and had been a life resident of Washington County. She was a 1988 graduate of Salem High School and attended Ivy Tech.
Lanna married Vincent R. Read, who survives. Also surviving are: 2 Daughters: Emily Danielle Davidson of Seymour and Kara Leigh Horner of Fort Bravo, Texas; Son: Andrew Logan Carlton of Salem; Father & Stepmother: Danny & Marsha Davidson of Salem; Mother: Carolyn Davidson of Medora; Sister: Andrea Leigh Davidson of Medora and 2 grandchildren.

Barbara “Bobbi” Vanover, age 82 of Pekin, Indiana, passed away on Sunday February 4, 2018 at the Baptist Health Floyd Hospital.
Born on December 8, 1935, she was the daughter of the late Harland Easton & Juanita (Hawk) Easton.
Bobbi was a member of the Eastview Church of Christ in Salem. She was formerly employed at the Banner Gazette.
Survivors include 2 daughters, Patricia Hardin (Joe), & Teena Balentine (Randy); brother, Mike Easton; sister, Janice Humphrey; 5 grandchildren & 12 great grandchildren.
Preceded in death by her parents, 1 brother, 1 sister, & grandson Josey Wells.
The funeral service will be at 2:00 PM Thursday at the Hughes-Taylor Funeral Home in Pekin.
Viewing will be from 10:00AM until time of service on Thursday at the funeral home. Burial will be at Crown Hill Cemetery in Salem.
The 2017 Methamphetamine Lab Statistics for Indiana have been released.
The numbers are encouraging as the total number of Meth Labs seized in Indiana dropped to 371 for the year of 2017.
This was a reduction from the number of labs seized in 2016 which was 943 and a large decrease from the number of labs seized in 2015 when it was 1,452.
The highest number of Meth Labs seized was in 2013 with 1,808 labs seized.
Law enforcement is encouraged about the reduction in the Meth Labs seized but understand that the fight is far from over and total victory over the problem would be zero Meth Labs seized.
The reduction in the numbers is a direct result of the combined effort of enforcement, education and rehabilitation by police, the courts, jails and the overall community awareness.
Unfortunately, another reason for the reduction is the increased flow of cheap Methamphetamine being funneled into the United States and eventually into Indiana by Latin American Criminal Gangs.
The increase in the rise of Heroin use is also a factor and an extremely disturbing fact.
The Indiana State Police is committed to continue the fight with the relentless pursuit of drug dealers and continued education to the public to the dangers of drug use.

Yesterday, the cooperation of multiple agencies led to a search warrant being served near Elizabethtown, Indiana. Four individuals were arrested on multiple drug related charges.
The investigation by the Indiana State Police-Versailles All Crimes Policing Unit in cooperation with the Jennings County Sheriff’s Department and Bartholomew County Sheriff’s and Columbus Police Department JNET Detectives led to a search warrant being obtained for 9555 N. County Road 700 West, Elizabethtown, Indiana.
While serving the search warrant at the residence, officers located methamphetamine, controlled substances, methamphetamine precursors, syringes, and drug paraphernalia. Indiana State Troopers arrested four individuals who were located at the residence.

All of the suspects were incarcerated at the Jennings County Jail pending their initial court appearances in the Jennings County Circuit Court.

Two from Salem were arrested over the weekend on drug charges, included possession of Cocaine.
Devin Coomer, 25, and MaKallie Quick, 20, both from Salem, fled a Scott County hospital and led police on a short foot chase.
At approximately 4:00 pm, troopers Tyler Matthew and Kyle Taylor went to the Campbell’s Motel in Scottsburg in reference to a possible stolen vehicle being in the parking lot of the motel.
They were looking for Devin Coomer, 25, from Salem, IN, who had an active arrest warrant.
The vehicle turned out not to be stolen but, when the troopers attempted to make contact with Devin Coomer at his room, he and his alleged girlfriend, MaKallie Quick, 20, also from Salem, IN, fled the motel room out of a back window.
After a short foot pursuit both subjects were captured.
A subsequent search of the motel room they were in revealed a syringe, a spoon with burnt white residue and suspected heroin.
Coomer was charged with Unlawful Possession of a Syringe, Possession of Cocaine or a Schedule 1 or 2 Narcotic Drug, Possession of Paraphernalia, Maintaining a Common Nuisance and an out of county arrest warrant.
MaKallie Quick was charged with Unlawful Possession of a Syringe, Possession of Cocaine or a Schedule 1 or 2 Narcotic Drug, Possession of Paraphernalia and Maintaining a Common Nuisance.
Both subjects were incarcerated at the Scott County Jail.
Indiana Conservation Officers are investigating an Off Road Vehicle (ORV) crash that seriously injured a fourteen year old juvenile.
At approximately 2:30 p.m. today, a fourteen year old juvenile was operating a 2000 Honda Rancher ES 350 ORV on private property at the 22000 block of Shale Road in Sunman, Indiana.
According to witnesses who were riding with the juvenile, they had been riding on the county roadway and entered the driveway of the private property.
The juvenile lost control of the ORV and hit a tree, ejecting him approximately eight feet down and into a creek.
Witnesses quickly pulled him from the creek and called 911.
The juvenile was not wearing a helmet at the time of the crash.
The juvenile was airlifted to the University of Cincinnati Hospital for injuries sustained. The extent of the juvenile’s injuries are not known at this time.
Indiana Conservation Officers, Dearborn County Deputies and Manchester Fire and EMS arrived shortly after the crash occurred. The crash is currently under investigation.
