Convenience stores suing for right to sell cold beer

The Indiana Petroleum Marketers and Convenience Store Association (IPCA), is prepared to challenge Indiana’s outdated law governing the sale of cold beer in court during a two day trial beginning Thursday, February 20 at 1p.

The issue will be heard by Chief Judge Richard L. Young, United States District Court for the Southern District of Indiana. cold_beer_bottles-t3

IPCA and its members’ filed a complaint in U.S. District Court  in May 2013 that claims Indiana’s alcohol law violates the equal protection clause of the U.S. Constitution by restricting convenience, grocery and pharmacy stores to selling beer only at room temperature. Under current law, these stores are only allowed to sell beer warm, while their competitors in the carryout market are allowed to sell beer cold even though convenience stores have a better compliance record with Indiana’s alcohol laws.

“Now is the time for common sense to be applied to Indiana’s alcohol laws, which are irrational, discriminatory and outdated,” said IPCA Executive Director Scot Imus. “We look forward to presenting our case in court as it is not the job of government to pick winners and losers in the marketplace.”

The hearing will last two days with the judge taking the matter under advisement and issuing a ruling at a later date.

With all the snow we have on the ground now melting, and with rain forecast for later in the week, you can bet Hoosier Motorists will be experiencing water covered roadways.  The Indiana State Police have listed some safety tips below in case you encounter high water conditions.W16-5_HighWater-500x500

•Always carry a cell phone and charger.
•Pay attention to local media reports and heed warnings issued by the National Weather Service.
•Never drive around barricades at water crossings.
•Be especially careful at night or early morning as it can be difficult to see water and it’s depth across the roadway.
•Reduce your speed in rain and NEVER enter flowing water.  Driving through water creates less tire contact with the road surface (hydroplaning) and increases your chance of crashing.
•Driving through water affects your brakes reducing their effectiveness until they dry out.
•If you end up in water, immediately exit your vehicle through a window and climb on top of your car. Call 9-1-1 from there and wait for help to arrive. Ride the top like a boat, as vehicles will often float for several minutes.
•Be aware that road erosion can occur anytime there is running or standing water on a roadway.
•Remember it only takes six inches of water to reach the bottoms of most car doors and one foot of water to float most vehicles.

If you find yourself stranded in water, act fast.  Get yourself and everyone in your vehicle out of their seatbelt and out a window onto the roof of the car.  Make sure you’re a survivor, NOT a victim.

Falling metal closes Assembly Hall until further notice

Indiana University Vice President and Director of Athletics Fred Glass has announced that tonight’s Big Ten men’s basketball game between Iowa and Indiana will be postponed as a result of a piece of metal falling from the ceiling into seats in the lower bowl.

Roughly 6 1/2 hours before gametime, a metal facing (roughly eight feet long by 14 inches wide), fell and damaged seats in the lower part of Section F, which is located in the northwest corner of the building.

“Safety is our No.1 priority,” noted Glass. Our University engineers have advised us to postpone events in Assembly Hall until it can be determined what caused the facing to fall and ensure the safety of everyone attending an event in the facility.”

The rescheduling of the Iowa contest and the status of tomorrow night’s women’s game with Michigan will be determined as soon as possible.

Scottsburg man arrested by ISP for battery and intimidation

Detectives from the Indiana State Police Post at Sellersburg received information from the Scott County Division of Child Services that alleged James Terry, 39, from 300 North Gardner Street, in Scottsburg, battered a small child and a female and then allegedly intimidated the female with death if she called the police.

After detectives spoke with James Terry earlier Monday, he was arrested  for Battery, D Felony, Intimidation, D Felony and Domestic Battery, A Misdemeanor.

He was incarcerated at the Scott County Jail awaiting his first court appearance.

We all know about the Christmas holiday, Easter, Thanksgiving.

But did you know that Presidents‘ Day is a federal holiday?  Actually, it‘s George Washington‘s birthday, but because several of our US presidents have birthdays around this time of year, the federal government combined their birthdays into one national holiday.

Local government offices, post offices, banks and the Stock Market (as well as Congress) is off for the day.

Presidents-Day1This as part of a government program called the Uniform Monday Holiday Act passed back in 1971.  The idea was an attempt to create more three-day week-ends for the nation‘s workers.

Originally, the holiday was created in 1880 to honor and observe the birthday of our founding president, and is still “officially” known as Washington‘s Birthday, on the third Monday in February.

But popularly, we celebrate Presidents‘ Day to honor all US presidents of the past and present.

Police Arrest 65 for Underage Drinking at Party

Police officers arrested 65 people for underage drinking at a party on the northwest side of Evansville Saturday night.

Evansville/Vanderburgh County Central Dispatch received several calls about a large underage drinking party and numerous vehicles parked in the roadway in 2700 block of Allens Lane in Evansville.

At midnight Sunday morning, officers from the Indiana State Excise Police, Vanderburgh County Sheriff’s Office and Indiana State Police, investigated these citizen complaints and found 65 minors who had been consuming alcoholic beverages inside a house and garage.

All but one of those found to have been drinking alcohol were issued summonses to appear in Vanderburgh Misdemeanor Court. One 19-year-old man was jailed on preliminary charges of illegal consumption of alcohol and resisting law enforcement.

Two of those cited for underage drinking were residents.

Four of the 65 minors were less than 18 years of age. They were all ticketed and released to parents.

As the enforcement division of the Indiana Alcohol and Tobacco Commission, the primary mission of the Indiana State Excise Police is to promote public safety by enforcing Indiana’s Alcoholic Beverage Code. While excise officers have the authority to enforce any state law, they focus primarily on alcohol, tobacco and related laws.

Excise Officers Arrest 38 at Concerts

Indiana State Excise Police officers arrested 38 people at concerts in Indianapolis and Evansville, Ind., this weekend.

On Friday night, excise officers arrested 14 people on 16 charges at the Florida Georgia Line concert at the Ford Center in Evansville. Ten minors – including one less than 18 years of age – were preliminarily charged with underage possession or consumption of alcohol.

Two adults were cited for providing alcohol to minors and one person was jailed on preliminarily charges of resisting law enforcement, disorderly conduct and public intoxication.

On Saturday night, excise officers arrested 24 people at a concert at Bankers Life Fieldhouse featuring Florida Georgia Line, Thomas Rhett and Brantley Gilbert. Nineteen minors – including one less than 18 years of age – were preliminarily charged with underage possession or consumption of alcohol. Two of them were also cited for possession of false IDs and one for being in a bar room.

Five people were cited for providing alcohol to minors and one person was issued a warning for carrying alcohol into the Fieldhouse.

Banker’s Life Fieldhouse was also cited on a preliminary charge of sale of alcohol to a minor after officers observed a bartender serve alcohol to a 19-year-old man without checking any identification.
